Defra and the Welsh Government have updated guidance on household waste duty of care for English local authorities on issuing fixed penalty notices. This follows on from a consultation in January 2018 on proposals to tackle crime and poor performance in the waste sector.
The responses to the January 2018 consultation are in the process of being analysed to determine if a fixed penalty notice (FPN) will be introduced. If it is, statutory guidance will be issued to provide advice to local authorities on how the FPN will be used.
This consultation is now live and will run for 8 weeks, to 27 August 2018.
